*Settlements completed on or before December 31, 2019, from new contracts for the purchase of any of Dan Ryan Builders’ inventory or to-be-built homes in the Emma Lane Town (Mount Pleasant, SC), Hunters Bend (Ladson, SC), Marshes at Park Circle (North Charleston, SC), Mixson (North Charleston, SC),  Phillips Creek (Mount Pleasant, SC), Riverstone (Moncks Corner, SC), Saltgrass Pointe (Charleston, SC), South Pointe Estate (Summerville, SC), Summers Corner (Summerville, SC), and The Ponds (Summerville, SC) subdivisions executed between July 22, 2019, and December 31, 2019, where the homebuyers (1) are relocating to the Charleston, SC area on or after the date of settlement and (2) are represented by a real estate agent or broker, as evidenced by a “Broker Co-Op” addendum (which shall be executed contemporaneously with the applicable contract to purchase a qualifying Dan Ryan Builders home), and the real estate agent or broker has entered into a third-party “re-location” agreement (“Third Party Agreement”) in connection with the homebuyers’ purchase wherein a portion of the real estate agent or broker’s commission is to be paid, remitted, or otherwise conveyed to such third-party (the “Payment”), will have said real estate agent or broker (“Potential Incentive Recipient”) receive, following settlement, a reimbursement (“Reimbursement”) in the amount of thirty percent (30%) of the Payment.  Limit (1) Reimbursement per contract.  Home availability subject to change without notice. To be eligible to receive a Reimbursement, (x) the Potential Incentive Recipient must be properly licensed as a real estate agent or broker by the State of South Carolina, and (y) the Third-Party Agreement (including, without limitation, the Potential Incentive Recipient’s obligation(s) to remit the Payment) must be delivered to Dan Ryan Builders at the time of contract execution, and be in full force and effect at the time of contract execution through settlement. In order to receive the Reimbursement, the Potential Incentive Recipient must disclose the Reimbursement in writing to the homebuyers prior to settlement, and shall present a copy of the Third-Party Agreement to Dan Ryan Builders (and/or such other documents reasonably satisfactory to Dan Ryan Builders).  The Potential Incentive Recipient may be required, as a condition of receiving a Reimbursement, to provide Dan Ryan Builders with their social security number and complete a W-9 or 1099-misc, as may be applicable, so that appropriate reports may be filed with applicable taxing authorities. The Potential Incentive Recipient is responsible for paying any and all state and federal income taxes, and any other taxes, fees, or costs, that may be incurred by the Potential Incentive Recipient in connection with receiving a Reimbursement.
